1)I have a few social media accounts and I am for certain of the things that I chose to disclose on social media and it is quite funny to me how far I have became and changed based on over the years of when I first started with a social media account and now. I would never lend my password to a company though because I am still entitled to my own privacy. I had to learn due to the jobs that have had, about being mindful because at the end of the day, your social media is basically a reflection of you for the most part. Employees are entitled and able to view ones account, depending on whats publicly available and yes is can cause you your job. Same as with groups and etc. Although there is a such thing as freedom of speech, something that an employer finds offensive and highly inappropriate can definitely have you terminated. You can not possibly think that you can post things such as pedophilia behavior and being sexually attracted to children and you’re a teacher. This you can immediately be terminated for. In the state of Florida, a hostile work environment laws is considered to be bullying, discrimination, workplace harassment of any sort, behavior that one see as a threat, or offensive comments. Freedom of Speech is the right to open expression of saying as you please. You have the right to Freedom of Speech just as well as you have the right to be held accountable for what you say. It has been eroded by throwing in the protection of others.
2)I have social media accounts and if I was asked to turn over my password I would refuse. If an agency needs that info that bad they can subpoena it. I understand the policy of my agency and keep my posts professional as to not bring disgrace on my agency
Yes, an employee can legally be terminated for what they post on their personal social media site, as private companies have the right to set their own policies regarding employee conduct. However, laws such as NLRA may provide protection for certain types of posts, such as those related to union activities.
Freedom of speech is the right to express any opinions without censorship or restraint. It is protected by the First Amendment of the US Constitution. The US Supreme Court has defined it as the right to express any idea, regardless of its social worth.
The Supreme Court has not yet issued a definitive ruling on the issue of censorship and firing for online speech. The Court has generally upheld the right to freedom of speech, but has also recognized the government’s interest in regulating certain types of speech, such as incitement to violence or false statements. The application of these principles to online speech is a complex issue that is still being considered by the courts.
In North Carolina, an employer can legally terminate an employee for posting pictures of deer they have killed on their Facebook page if the employer finds it offensive. However, it is important to note that this may not be considered discrimination if the employee’s hunting activities are not related to a protected class under state or federal laws.
